Who we are.
This website (the “Site”) is operated by Innovations Numériques BD Outlier Inc. (“BD Outlier”, “we”, “us”, “our”), based in Montréal, Québec, Canada. Our Site explains our services and links you to the Outlier3D login. (Use of Outlier3D is governed by its own terms and privacy policy.)

1) TERMS OF USE

1.1 Acceptance of these Terms
By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1.2 Use of the Site
You may use the Site only for lawful purposes. Do not (a) attempt to gain unauthorized access to any systems; (b) interfere with the Site’s operation; (c) copy, scrape, or reverse‑engineer the Site; or (d) infringe intellectual property rights.

1.3 Content and Intellectual Property
Unless otherwise noted, the Site, its design, text, graphics, logos, and other content are owned by BD Outlier or our licensors and are protected by intellectual‑property laws. You may not reproduce or distribute Site content without our prior written permission.

1.4 Third‑Party Services (including Outlier3D)
The Site may link to third‑party websites or services. Those services are not controlled by us and have their own terms and privacy policies.

1.5 No Warranties‍
The Site is provided “as is” and “as available”. We do not guarantee the Site will be uninterrupted, accurate, or error‑free.

1.6 Limitation of Liability
To the maximum extent permitted by applicable law, BD Outlier will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site. Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited under Québec law—including liability for bodily or moral injury, or for material injury caused by intentional or gross fault.

1.7 Changes to the Site and Terms
We may update the Site and these Terms from time to time. If we make material changes, we will update the “Last updated” date above.

1.8 Governing Law and Jurisdiction
These Terms are governed by the laws of Québec and the laws of Canada applicable therein. Any dispute will be heard in the courts of the Judicial District of Montréal, Québec.

2) PRIVACY POLICY (Canada & Québec)

• We collect only what we need to answer your inquiries, manage our relationship, and operate a simple website.
• We use only essential cookies on this Site (no advertising cookies; no analytics by default).
• Outlier3D has its own privacy policy that applies when you log in there.
• You have privacy rights in Québec (access, correction, withdrawal of consent, portability, etc.). We respond within 30 days and we publish a privacy officer’s contact details.

2.1 Scope
This Privacy Policy applies to personal information we handle through this Site and our direct communications with you (e.g., contact forms, email). When you use Outlier3D, the privacy practices of that service apply.

2.2 What we collect‍

• Contact information you provide (e.g., name, email, company, phone) when you submit a form or contact us.
• Business details related to a potential or ongoing engagement (e.g., project scope).
• Technical essentials for security and delivery (e.g., web server logs, strictly necessary cookies).
  We collect only information necessary for purposes determined before collection, and by lawful means, consistent with Québec’s private‑sector privacy law.

2.3 Cookies

• What we use here: Strictly necessary cookies only—to make the Site work (for example, basic security and page delivery).
• What we do not use here by default: No advertising cookies and no analytics tracking on this Site. If we later introduce optional analytics, we will ask for your meaningful consent first and provide clear choices

Note: In Canada, cookies that collect personal information for tracking/targeting generally require knowledge and consent under federal guidance (PIPEDA). We follow those consent principles.

2.4 Why we use personal information (purposes)

• To respond to inquiries and provide information about our services
• To prepare, negotiate, or manage a services relationship
• To operate, secure, and improve the Site (strictly necessary functions)
• To meet legal and regulatory obligations

2.5 Legal framework we follow

• Québec (Act respecting the protection of personal information in the private sector, “P‑39.1” / Law 25 amendments): we designate a privacy officer, publish contact details, adopt governance practices, keep a confidentiality‑incident register, and notify the CAI and affected individuals of incidents that present a risk of serious injury. We conduct a privacy impact assessment (“PIA”) where required (e.g., new systems or cross‑border communications).
• PIPEDA (federal): may apply where personal information crosses provincial or national borders in the course of commercial activities; we apply the OPC’s meaningful consent principles to ensure transparency and control.

2.6 Transfers outside Québec / Canada
If we host or process personal information outside Québec (or appoint service providers outside Québec), we will conduct a privacy impact assessment and ensure that the information receives adequate protection, considering sensitivity, purposes, safeguards, and the legal framework of the destination. We will also disclose that personal information may be transferred outside Québec.

We apply security measures appropriate to the sensitivity, purposes, quantity, and medium of personal information we hold, and we keep decision‑related information for at least the periods required by law.

2.8 Confidentiality incidents (breaches)
If a confidentiality incident presents a risk of serious injury, we will promptly notify Québec’s Commission d’accès à l’information (CAI) and affected individuals, and we keep a register of such incidents. Under PIPEDA, where applicable, we report breaches that create a real risk of significant harm and keep records of all breaches.

2.9 Your privacy rights (Québec & Canada)
Subject to legal limits, you may:

• Access and correct your personal information;
• Withdraw consent (for future uses);
• Request deletion where appropriate under applicable law;
• Be informed if a decision about you was made exclusively by automated processing and request an explanation and human review;
• Request data portability: obtain computerized personal information you provided in a structured, commonly used technological format, and—where technically feasible—have us transmit it to an authorized third party. (This portability right is in force in Québec.)

We respond to privacy requests within 30 days (or as required by law). To exercise rights, contact our Privacy Officer (see contact above).

2.10 How long we keep information
We retain personal information only as long as necessary for the purposes set out above and to meet legal obligations. We then securely delete or de‑identify it.

2.11 Outlier3D
When you click “Log in to Outlier3D”, you leave our Site and access a separate service. Your Outlier3D account data is handled under Outlier3D’s own terms and privacy policy. Please review those documents before using that service.

2.12 Changes to this Policy
We may update this Policy from time to time. If changes are material, we will post a notice on the Site and update the “Last updated” date.
